Information Defined

Two types of information may be collected through the Site: Personal Information and Non-Personal Information. This Privacy Policy does not extend to the collection, use or disclosure of the following information which is currently not limited by applicable privacy laws: (a) information that is publicly available, such as names, addresses, telephone numbers and electronic address when listed in a directory or made available through directory assistance and business contact information; or (b) Non-Personal Information (as defined further below. Although not limited by privacy law, we provide information in this Privacy Policy about the collection of Non-Personal Information in the interest of transparency with respect to the operation of the Site.

Information We Collect

We collect two types of information from you: i) information that you voluntarily provide to us (e.g. through a voluntary registration process, sign-ups or emails); and ii) information that is derived through automated tracking mechanisms.

Registration Information
In order to access all features of this Site, you must first complete the registration process, during which we will collect Personal Information about you. The information will include your name, company, and email address.
Voluntary Information for Services and Features
We also collect Personal Information when you choose to use certain other features of the Site, including: i) creating a portal, ii) making requests, iii) consenting to receive email or text messages about upcoming features, iv) consenting to receive email. When you choose to use these additional features, we require you to provide contact information (eg. your name, email address and/or phone number) in addition to other Personal Information that may be required to complete a transaction such as your phone number, billing and shipping addresses and credit card information. Occasionally, we may also request information such as your shopping preferences and demographics which will help us better serve you and our other users in the future.
Cookies
The Site uses "cookies" and other tracking technologies. Cookies enable us to serve secure pages to our users without asking them to sign in repeatedly and to gather information about your use of the Site and services. Most browsers allow you to control cookies, including whether or not to accept them and how to remove them. If a user's system is idle for a defined time, the cookie will expire, forcing the user to sign in again to continue their session. This prevents unauthorized access to the user's information while they are away from their computer. You may set most browsers to notify you if you receive a cookie, or you may choose to block cookies with your browser, but please note that if you choose to erase or block your cookies, you will need to re-enter your original username and password to gain access to certain parts of the Site.
Referrals

You may choose to invite others to join the Site and the Cybermedex community by sending invitation emails via our invite feature. Cybermedex stores the email addresses you provide so that the respondents may be added to your portal, confirm permissions, and also to send reminders of the invitations. Cybermedex does not sell these email addresses or use them to send any other communication besides invitations and invitation reminders. Recipients of invitations will be provided with means to request removal of their information from our database.

How We Use Your Information

Cybermedex only uses your Personal Information for the original purposes for which it was given. If we plan to use your Personal Information in the future for any additional purposes, we will only do so after informing you by updating this Privacy Policy.

We may use your Personal Information for target advertising toward you based on things such as age, gender, interests, goals, habits, etc.

Please note that Personal Information is used to provide you with a more enjoyable, convenient online experience and to help us identify and/or provide information, products or services that may be of interest to you. We use your Personal Information to support and enhance your use of the Site and its features, including without limitation: providing customer service, tracking email invitations you send, and responding to questions you send us.

If you register for an account with us, we will keep you up to date on our products and services. You may withdraw your consent to receive marketing communications from us at any time by following the opt-out instructions in each communication. However, we may also provide transactional notifications relating to your use of our Site, updates to this Privacy Policy and our Terms of Use and other important notifications which you cannot opt out of despite your indicated email preferences. We use non-personally identifying and aggregate information to better design our website and for business and administrative purposes. We may also use or share with third parties for any purpose aggregated data that contains no Personal Information.

Third Party Advertising

Advertisements do not appear on this Site.

This Privacy Policy explains the use of cookies by Cybermedex.

Disclosures and Transfers

We have put in place contractual and other organizational safeguards with our agents to ensure a proper level of protection of your Personal Information. In addition to those measures, we will not disclose or transfer your Personal Information to third parties without your permission, except as specified in this Privacy Policy.

Our servers are also located in the Canada and accordingly your Personal Information may be available to the Canadian government or its agencies under a lawful order, irrespective of the safeguards we have put in place for the protection of your Personal Information.

Also, we may share Personal Information or other information with our parent, subsidiaries, divisions, and affiliates.

We may transfer Personal Information as an asset in connection with a proposed or actual merger or sale (including any transfers made as part of an insolvency or bankruptcy proceeding) involving all or part of our business or as part of a corporate reorganisation, stock sale or other change in control.

Cybermedex may disclose Personal Information in special cases where we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating our terms and conditions of use or may be causing injury or interference with our rights, property, our customers or anyone who could be harmed by such activities.

Disclosure of Processed Data

Cybermedex will not disclose or provide access to any Processed Data except:

  1. as Customer directs;
  2. as described in this DPA; or
  3. as required by law.

For purposes of this section, “Processed Data” means:

  1. Customer Data;
  2. Professional Services Data;
  3. Personal Data; and
  4. any other data processed by Cybermedex in connection with the Products and Services that is Customer’s confidential information.

All processing of Processed Data is subject to Cybermedex’s obligation of confidentiality. Cybermedex will not disclose or provide access to any Processed Data to law enforcement unless required by law. If law enforcement contacts Cybermedex with a demand for Processed Data, Cybermedex will attempt to redirect the law enforcement agency to request that data directly from Customer. If compelled to disclose or provide access to any Processed Data to law enforcement, Cybermedex will promptly notify Customer and provide a copy of the demand unless legally prohibited from doing so.

Upon receipt of any other third-party request for Processed Data, Cybermedex will promptly notify Customer unless prohibited by law. Cybermedex will reject the request unless required by law to comply. If the request is valid, Cybermedex will attempt to redirect the third party to request the data directly from Customer.

Cybermedex will not provide any third party:

  1. direct, indirect, blanket, or unfettered access to Processed Data;
  2. platform encryption keys used to secure Processed Data or the ability to break such encryption; or
  3. access to Processed Data if Cybermedex is aware that the data is to be used for purposes other than those stated in the third party’s request.

In support of the above, Cybermedex may provide Customer’s basic contact information to the third party.

How We Protect Your Information

We use commercially reasonable security measures to protect your information against unauthorized access to or unauthorized alteration, disclosure or destruction of data. We maintain appropriate technical, contractual, administrative, and physical measures designed to protect the Personal Information that you provide to us. While no computer system is completely secure, we believe the measures we have implemented reduce the likelihood of security problems to a level appropriate to the type of data involved.

Retention

We will keep your personal information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you. We may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery, or if required by law. All retained personal information will remain subject to the terms of this Privacy Policy. If you request that your name be removed from our databases, it may not be possible to completely delete all your personal information due to technological and legal constraints.

Accessing and Updating Your Personal Information and Preferences

You have the right to access the Personal Information we hold about you in order to verify the Personal Information we have collected in respect to you and to have a general account of our uses of that information. Upon receipt of your written request, we will provide you with a copy of your Personal Information although in certain limited circumstances, we may not be able to make all relevant information available to you such as where that information also pertains to another user. In such circumstances we will provide reasons for the denial to you upon request. We will endeavor to deal with all requests for access and modifications in a timely manner.

We provide mechanisms for updating and correcting your personal information for many of our services. You may modify or remove any of your personal information at any time by logging into your account and accessing features such as edit and account.

Email Choice/Opt-out

If you no longer wish to receive optional updates or notifications, you may opt-out of receiving these communications by changing your “email notification? settings in your account settings. Alternatively, you may send an email to support@cybermedex.com We will make commercially reasonable efforts to implement your opt-out requests promptly, but you may still receive communications from us for up to 3 business days as we process your request.

Children's Privacy and Parental Controls

We do not solicit any personal information from children. If you are not 18 or older, you are not authorized to use the Site. Parents should be aware that there are parental control tools available online that can be used to prevent children from submitting information online without parental permission or from accessing material that is harmful to minors. If we become aware that we have received any Personal Information of minors, we will delete such information from our system.

Disclaimer to Security

By consenting to the Terms and Conditions of the Site and this Privacy Policy, you consent that no data transmission over the Internet is completely secure. We cannot guarantee or warrant the security of any information you provide to us and you transmit such information to us at your own risk.

Changes to this Privacy Policy

We reserve the right to change this Privacy Policy at any time. If we decide to change this Privacy Policy in the future, we will post an appropriate notice on the home page of the Site. Any non-material change (such as clarifications) to this Privacy Policy will become effective on the date the change is posted and any material changes will become effective 10 days from their posting on the Site. Unless stated otherwise, our current Privacy Policy applies to all Personal Information that we have about you. The date on which the latest update was made is indicated at the top of this document. We recommend that you print a copy of this Privacy Policy for your reference and revisit this policy from time to time to ensure you are aware of any changes. Your continued use of the Site signifies your acceptance of any changes.
